Terms of Service
These Terms of Service ("Terms") govern your use of evieko.com and any purchase you make from EVIEKO GROUP ("EVIEKO", "we", "us"), 63 Wilson Boulevard, Reservoir VIC 3073, Australia. By placing an order you agree to these Terms. If you do not agree, please do not use the store.
1. Products and descriptions
We take care to describe products accurately. Technical data (lumens, battery capacity, run time, IP rating, dimensions) are manufacturer specifications measured under standard conditions; real-world performance, especially run time, depends on sunlight, location, season and installation. Minor variations in colour, finish and packaging may occur. We may update specifications and discontinue products without notice.
2. Prices and payment
All prices are in US dollars (USD) and, unless stated otherwise, exclude import duties and local taxes that may be charged in your country. Shipping is calculated at checkout. We accept the payment methods shown at checkout, processed securely by Shopify Payments and its partners. In the event of an obvious pricing error we may cancel the affected order and refund you in full.
3. Orders
Your order is an offer to buy. We accept it when we send the shipping confirmation. We may refuse or cancel an order where we suspect fraud, where a product is unavailable, or where a pricing or stock error has occurred; any payment taken will be refunded. Orders are subject to our Shipping Policy and Returns, Refunds & Warranty Policy, which form part of these Terms.
4. Quotations and project sales
Products marked "Request a Quote" are sold on the basis of a written quotation from EVIEKO. The quotation sets out the price, quantity, specification, freight, lead time and payment terms, and prevails over these Terms where they conflict. Quotations are valid for 30 days unless stated otherwise.
5. Consumer guarantees and liability
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law, and you may also have rights under the consumer law of your country. To the extent permitted by law, our liability for any claim relating to a product is limited to replacing or repairing the product or refunding its price, and we are not liable for indirect or consequential loss (such as installation costs or loss of business). Nothing in these Terms excludes liability that cannot be excluded by law.
6. Installation and safe use
Products must be installed and used in accordance with the supplied instructions and applicable local regulations. Mains-connected or pole-mounted commercial products must be installed by suitably qualified persons. EVIEKO is not responsible for damage or injury arising from incorrect installation or misuse.
7. Intellectual property
The EVIEKO name, logo, product content, photographs and text on this site are owned by or licensed to EVIEKO GROUP and may not be reproduced without written permission.
8. Accounts and conduct
You are responsible for keeping your account login confidential and for all activity under it. You must not use the store for any unlawful purpose or attempt to interfere with its operation.
9. Third-party links
Our site may link to third-party websites or services. We are not responsible for their content or privacy practices.
10. Governing law
These Terms are governed by the laws of Victoria, Australia, and the courts of Victoria have non-exclusive jurisdiction, without limiting any mandatory consumer protection you enjoy in your country of residence.
